Introduction

This Privacy Statement is applicable to the Vessel Detector application (“Application”) developed and exploited by Rombit NV, having its registered office in Belgium, Meir 30, 2000 Antwerp and registered in the Crossroads Bank for Enterprises under number BE 0846.801.288 (“Rombit”).

Rombit considers the protection of personal privacy extremely important. Rombit wishes to inform and respect you, as member and user of the Application, as much as possible, and give you as much control as possible about what happens with your personal data.

Your personal data and your privacy are protected by Rombit in conformance with the Belgian and European law regarding the protection of privacy. A statement was delivered to the Commission for the Protection of Privacy with regard to the processing of your personal data.

This Privacy Statement is a part of the General Terms and Conditions of Rombit, and has to be read carefully. This Statement does not only describe your rights, but also the ways in which you can exercise these rights.

By using the website and providing your personal data, you explicitly agree with the way in which your personal data is collected and processed, as described in this Privacy Statement.

1. What data is collected and processed?

1.1. Rombit processes several types of personal data (“Information”) through its Application:

  1. Personal information: a.o. vessel names, vessel appearance, vessel type, vessel location etc.;
  2. Technical information: a.o. camera data, lens information, PTZ position, geolocation etc.;
  3. Company information: a.o. company name, email address, contact information of the companies who purchase and install our Application etc.; 
  4. Logs: a.o. error and log messages generated by the Application during use etc..

1.2. Rombit collects data via the Azena platform (Company information) as well as through its Application (Personal information, Technical information and Logs).

2. What is the data used for?

2.1. Rombit uses your personal data for multiple purposes.

2.2. Rombit uses the data collected via the Application for the geolocalization and identification of maritime vessels.

2.3. Rombit uses the data collected via the Azena platform for commercial purposes including, but not limited to payment management, customer satisfaction surveys and contextual inquiry for the betterment 

2.4. Additionally, Rombit may use the collected data to:

  1. enable you to use the Application correctly in accordance with your personal settings;
  2. manage a generic customer file;
  3. communicate with you about related products and services;
  4. generate anonymous statistics about (the users of) the Application;
  5. improve the Application;
  6. manage a generic camera calibration database containing lens characteristics.
  7. notify our users of any changes to this Privacy Statement

2.5. Finally, Rombit may request your express permission to collect additional data in the form of video frames or fragments for the improvement of its machine learning algorithms or for training additional algorithms.

2.6. By using our Application, you accept that your personal data and other information that you provide, inclusive of sensitive personal information, may be available outside Belgium. In this context, it is possible that the legislation of non-European countries guarantees less strict protection of your personal data.

3. Sharing of personal data

3.1. To avoid receiving unsolicited email messages from third parties, your email address is not shared with third parties, except in the cases mentioned in article 9.

3.2. Statistical and anonymous information can be shared for marketing and/or promotion purposes.

3.3. Without your explicit consent, Rombit will not share with third parties any personal data that can be used to identify you, except when required for the operation of the Application and in the cases mentioned in article 9.

4. Google Analytics

4.1. This Application uses Google Analytics, a web analysis service offered by Google Inc. (“Google”). Google Analytics uses cookies to analyze how users use the Application.

4.2. The information retrieved from your use of the Application, such as your IP-address, is being transmitted to Google and stored by Google on their services in the United States. Google uses this information to track how you use the Application, to elaborate reports for us about our Application. Google can provide this information to third parties if Google is legally bound to, or for as far as these third parties process this information on Google’s behalf.

4.3. Google will not combine your IP-address with other data that Google has. You can deny the use of cookies in the settings of your Internet browser. In that case, it might be that you are not able to use all the potential of the Application. By using this Application, you approve the processing of the information by Google in the way and for the goals described above.

5. Retention period and storage of personal data

5.1. Rombit applies the following retention period of your personal data:

  1. personal and company information: retention period of maximum six (6) months after the deletion of the specific information or the complete deletion of your user account;
  2. logs: retention period of maximum six (6) months as of the creation of the item or the log;
  3. technical information
    1. For identifiable information: retention period of maximum six (6) months after the deletion of the specific information of the complete deletion of your user account.
    2. For anonymized lens characteristics: retention period of maximum four (4) weeks after specific written request for the information to be deleted by the user.

5.2. Your personal data will be stored in databases hosted by a country within the EU.

6. Security measures

6.1. Rombit has established several security measures to avoid the loss, wrong use or alteration of your personal data. To do so, Rombit employs a team of trained engineers and utilizes up-to-date technologies and tools.

6.2. Rombit makes all necessary efforts to protect the confidentiality of your personal data.

6.3 In no event will Rombit be held responsible for any direct or indirect damages that result from a wrongful or illicit use of the personal data by a third party.

7. Rights of the user

7.1. You have the right to request access to personal data (and know its content and origin), verify its accuracy, request its integration, revision or deletion. You also have the right to request the transformation into anonymous form, blocking of data processed in violation of the law, and to oppose, in any case, for legitimate reasons, to their processing. 

7.2. To exercise the aforementioned rights, you can contact our Data Controller via email to dpo@rombit.com or via a letter to Rombit NV, Meir 30, 2000 Antwerp, Belgium, under the condition of attaching a copy of your ID.

8. Changes to this Privacy Statement

8.1. This Privacy Statement may be changed at any time. 

8.2. Changes are published on our Website (www.rombit.com). You will be notified via email of changes to the Privacy Statement in order to keep you updated at all times on the information we collect, how we use and in what way we share that information. 

8.3. Changes to this Privacy Statement take effect ten (10) days after the publication thereof on our Website.

9. Approval for release

9.1 You acknowledge and explicitly give permission to Rombit to disclose your Information if required by law, or if Rombit in good faith beliefs that such an action is necessary to

  1. comply to an active legal procedure, court order or legal process with regard to the Application;
  2. enforce the General Terms and Conditions of Rombit;
  3. react to damage claims against Rombit in relation with your Information infringing the rights of third parties;
  4. safeguard the rights, title and security of Rombit, her staff and employees, users and the public.

9.2 Rombit may also publish Information about you to the police, legal authorities or any other official government department, if Rombit in good faith believes this to be required or useful, in relation to a fraud investigation, intellectual property violation, or any other damaging action, or if Rombit may reasonably suspect such an action could expose either Rombit or yourself to liability. 

10. Legislation

10.1. This Privacy Statement is governed, interpreted and implemented in accordance with Belgian law, which exclusively applies in case of a potential dispute.

10.2. The courts of the legal district of Antwerp, department Antwerp, are exclusively competent to rule on each and every dispute that may derive from the interpretation or from the implementation of this Privacy Statement.
