Hardware Warranty
and RMA Policy

Introduction

This Hardware Warranty and Return Material Authorization Policy is part of Rombit’s Romware General Terms and Conditions, and extends its Article 13 for Hardware Products.

To the extent permitted by law, this warranty and the remedies set forth are exclusive and in lieu of all other warranties, remedies and conditions, whether oral, written, statutory, express or implied. Rombit disclaims all statutory and implied warranties, including, without limitation, warranties of merchantability and fitness for a particular purpose and warranties against hidden or latent defects.

1. Warranty

1.1 A Rombit Hardware Product requires a valid Rombit Software Product License to function in accordance with its specifications. The warranty provided to any Hardware Product is dependent upon having an active license for such Hardware Product. Any warranty provided in this policy becomes void from the moment you no longer hold a valid license for that Hardware Product.

1.2 Standard Warranty: Rombit warrants and guarantees the proper functioning of each Hardware Product for a minimum period of one (1) year or the minimum period that is required by law in the jurisdiction defined in your Agreement, from the Date of Delivery. The Standard Warranty is only available for purchased Hardware Products.

1.3 Extended Warranty: For some purchased Hardware Products, you may choose to purchase an Extended Warranty that supplements the Standard Warranty. All Extended Warranties extend the Standard Warranty by the term defined in and associated with the purchased Extended Warranty.

1.4 Rented or Leased Hardware: Rombit warrants and guarantees the proper functioning of each Hardware Product for as long as you maintain a valid license for such Hardware Product. 

1.5 The proper functioning of a Hardware Product is understood to mean the functioning that substantially corresponds to the specifications described in the relevant Order Form. In case the Hardware Product does not substantially correspond to the described specifications and exhibits material defects, it will be replaced free of charge as described in the RMA Policy.

1.6 This warranty does not include the replacement of Hardware where the malfunctioning is caused by; 

1.6.1 Shortcomings with regard to the installation conditions as described by Rombit (of by its suppliers and/or licensors);

1.6.2 The use of the Hardware or a Hardware component for purposes other than those for which it is intended;

1.6.3 The use of the Hardware in locations or external conditions that do not conform to Rombit’s product specifications;

1.6.4 Damages occurring in transit;

1.6.5 The treatment of the Hardware in any manner that could cause the Hardware or a Hardware component to become damaged or defective;

1.6.6 Changes, including any transformation of its physical, electrical or mechanical design;

1.6.7 Additions, including any mechanical, electrical or electronic coupling of or to any other device or equipment not supplied by Rombit, the change of one model to another model or the addition or removal of special equipment without Rombit being involved;

1.6.8 By virus, infection, worm or any other software code not introduced by Rombit;

1.6.9 Any malfunction that is not caused by any cause found in the Hardware or Software itself;

1.6.10 As a result of an accident, misuse, liquid spills, abuse, contamination, improper or inadequate or insufficient maintenance or calibration;

1.6.11 Normal wear and tear.

2. Return Policy

2.1 In order for a Hardware Product to be eligible for a possible return, the customer must have followed the first levels of troubleshooting available on support.rombit.com

2.2 If the Hardware Product remains defective after the troubleshooting steps, you can send a RMA request via your support login on support.rombit.com. Only requests entered through the support platform by the original purchaser as stated on the relevant Order Form will be eligible for a possible return. In the RMA request, you are required to provide all essential information about the Hardware Product, such as ID number, detailed defect description, results of troubleshooting steps and replacement shipping address, to allow Rombit to assess the problem adequately. 

2.3 If your RMA request is approved, Rombit will provide you with the information needed to return the Product to Rombit free of charge. After full processing of the approval, Rombit will ship the replacement Hardware Product to the shipping address defined in your request.

2.4 Rombit will upon its own choice and to the extent permitted by law replace the defective Hardware Product with a Hardware Product that (i) is equal to or able to deliver the same functionality as the defective Hardware Product, (ii) is new or is in a condition that delivers equal reliability and performance as new.

2.5 You are obliged to return the Hardware Product in its entirety, including all power supplies, antennas, cabling and any other component that is needed for the Product to function properly, securely and properly packaged.

2.6 You are obliged to return the defective Hardware Product to Rombit within fourteen (14) days of receiving the approval or your RMA request, based on the return information provided by Rombit with the approval. If you haven’t sent the Products within this fourteen (14) days, Rombit reserves the right to charge you, and you agree to pay, the fees and costs associated with the shipping of both the returned Hardware Products and the replacement Hardware Products. 

2.7 Should the Hardware Product returned by you (i) deemed not to be defective or ‘no fault found’, (ii) deemed to be malfunctioning because of any cause listed in article 1.6, at Rombit’s sole discretion, or (iii) be missing any Hardware or components as described in article 2.5, Rombit will invoice you, and you agree to pay, the cost of the Hardware Product replacement.

3. Limitation of Liability

3.1. Except as provided in this warranty and to the maximum extent permitted by law, Rombit is not responsible for direct, special, incidental or consequential damages resulting from any breach of warranty or condition, or under any other legal theory, including but not limited to loss of use; loss of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill; loss of reputation; loss of, damage to, compromise or corruption of data; or any indirect or consequential loss or damage howsoever caused including the replacement of equipment and property, any costs of recovering, programming, or reproducing any program or data stored in or used with the rombit hardware product or any failure to maintain the confidentiality of information stored in the rombit hardware product.
